1. Acceptance of Terms
Welcome to Youcast.cloud (hereinafter, "Youcast," "Platform," "Service," "We," "Us," or "Our"). These Terms of Use ("Terms" or "Agreement") govern your access to and use of Youcast.cloud. By accessing or using our Platform, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. Beta Disclaimer
⚠️ Beta Status: Youcast.cloud may still be in beta testing, which means:
- The Service may have bugs, errors, or interruptions.
- We do not guarantee uptime, stability, or performance.
- Feedback: You agree to provide feedback to help us improve the Service.
- Liability: To the fullest extent permitted by law, we are not liable for any damages or losses arising out of your use of a beta version of the Platform.
If you do not agree to use a beta service under these conditions, do not use Youcast.cloud until it is out of beta.
3. Description of the Service
- Streaming Functionality: Youcast.cloud provides a platform to schedule, automate, and manage 24/7 livestreams or recurring broadcasts, primarily leveraging YouTube API v3.
- YouTube Integration: Users connect their Google (YouTube) accounts to create and manage live broadcasts.
- Third-Party Services: Certain features or integrations may rely on third-party platforms (e.g., YouTube, Twitch, Facebook). Your use of these platforms remains subject to their respective Terms of Service and Privacy Policies.
4. User Responsibilities
By using Youcast.cloud, you agree that:
- Legal Compliance: You will comply with all applicable laws and YouTube’s Terms of Service (as well as other third-party platform rules, if applicable).
- Content Rights: You are responsible for the content you stream, and you must have all necessary rights, licenses, and permissions to upload or broadcast such content.
- Prohibited Activities: You will not use the Service for illegal, harmful, abusive, or fraudulent activities, including but not limited to: violating intellectual property rights of others; uploading or streaming any content that is defamatory, obscene, or incites violence; attempting to hack or disrupt our Service or other users’ streams.
- Account Security: You are responsible for safeguarding your login credentials and for any activity under your account. If you suspect unauthorized use, please notify us immediately.
5. Google API & Data Usage
- YouTube API v3: We utilize YouTube API v3 to enable 24/7 streaming, creating, and managing live streams on your behalf.
- Authorization: By connecting your Google account, you grant us permission to store and use authentication tokens (OAuth tokens) to interact with YouTube on your behalf.
- Storage & Protection: We do not store your raw Google login credentials. We securely store authentication tokens in our database, in compliance with Google’s Limited Use Policy. We do not share your tokens or related data with unauthorized third parties.
- Data Scope: We collect only the data necessary to provide the streaming functionality (e.g., stream settings, broadcast IDs, scheduling information).
- Compliance: We comply with Google’s policies, including the Limited Use Policy for handling user data obtained via restricted scopes.
6. Content Storage & Ownership
- User Content: You retain ownership of any videos or other media you upload or stream via Youcast.cloud.
- License to Us: By using the Service, you grant us a non-exclusive, worldwide license to process, transmit, and store your content solely for the purpose of operating and improving the Service.
- Storage on Our Servers: While using our 24/7 or automated streaming features, some of your videos may be stored on our servers. We strive to keep data secure, but we cannot guarantee absolute protection from all cyber threats.
- Responsibility: Youcast.cloud is not responsible for any legal issues arising from your stored or streamed content (e.g., copyright infringement claims, defamation, or privacy violations).
7. Service Availability & Modifications
- No Guarantee: We strive for continuous operation but do not guarantee uninterrupted or error-free service.
- API Restrictions: We are not liable for any disruption or limitation arising from YouTube API changes, restrictions, or downtime.
- Feature Changes: We may modify, update, or discontinue certain features at any time without prior notice, especially during the beta phase.
- Future Paid Plans: Youcast.cloud currently offers both free and paid subscriptions. By subscribing to a paid plan, you agree to the associated pricing and billing terms displayed at checkout. You will be notified in advance of any changes to pricing or billing cycles. If we introduce paid subscriptions or additional features, you will be notified and required to accept any new payment terms before charges apply.
8. Termination & Suspension
- By You: If you wish to delete or terminate your account, you may request this by contacting us at support@youcast.cloud.
- By Us: We reserve the right to suspend or terminate your access if you violate these Terms, abuse our Service, or engage in any activity causing harm to our Service or other users.
- Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete or suspend access to any of your stored data unless otherwise required by law.
9. Disclaimers & Limitation of Liability
- “As Is” / “As Available”: To the maximum extent permitted by law, Youcast.cloud is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
- No Warranty: We disclaim all warranties, including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability: We are not liable for any indirect, incidental, special, or consequential damages (including loss of profits, revenue, or data). Our maximum liability to you for any claim related to the Service is limited to the amount you have actually paid us in the last 12 months (currently $0 if the Service is free). We are not responsible for any legal issues, strikes, or bans imposed by YouTube or other platforms due to your content or conduct.
- Beta Usage: If you are using a beta version of the Service, you specifically acknowledge the inherent risk of bugs and interruptions and agree that we assume no liability for any resulting damages.
10. Intellectual Property
- Our IP: Youcast.cloud (and its underlying software, design, and branding) is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.
- User Marks: You retain any rights to trademarks or service marks you upload, but you grant us permission to display them as needed for providing the Service (e.g., in a broadcast or account dashboard).
11. Indemnification
- To the fullest extent permitted by law, you agree to indemnify and hold harmless Youcast.cloud and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to:
- your use or misuse of the Service;
- your violation of these Terms;
- your infringement of any third-party rights (e.g., copyright, trademark, or privacy);
- any legal disputes related to the content you stream or store via the Service.
12. Governing Law & Dispute Resolution
- Governing Law: These Terms are governed by the laws of Ukraine (or other applicable jurisdiction), without regard to conflict-of-law principles.
- Mandatory Consumer Rights: Nothing in these Terms limits any mandatory consumer protection rights that you may have under the laws of your country of residence.
- Dispute Resolution: Parties shall attempt to resolve disputes amicably through negotiations. If a dispute cannot be settled, it may be brought before the competent courts of Ukraine, unless otherwise required by local mandatory law.
13. Modifications to Terms
- Right to Modify: We may update or revise these Terms at any time.
- Notice: We will notify you of significant changes via email or Service notifications.
- Acceptance of Changes: By continuing to use the Service after the revised Terms become effective, you accept and agree to the updated Terms.
14. Force Majeure
We shall not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, wars, acts of terrorism, labor disputes, or government actions that prevent the Service from functioning.
15. Severability
If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to be valid and enforceable.
16. Entire Agreement
These Terms, together with the Privacy Policy and any additional legal documents referenced, constitute the entire agreement between you and Youcast.cloud regarding the Service and supersede all prior agreements or understandings.

18. Refund Policy
- We strive to ensure our users are satisfied with the services provided through Youcast.cloud. However, if you are not satisfied with your purchase, you may request a refund under the following conditions:
- Refund requests must be submitted within 14 calendar days from the date of the initial payment.
- Refunds are only applicable if there was no substantial use of the Service, such as: no active streams were launched; no videos were uploaded to the system; no automated or scheduled tasks were triggered.
- Refunds will not be granted for: partial use of a subscription period; situations where the service was used in violation of these Terms; technical limitations outside of Youcast.cloud’s control (e.g., issues on YouTube's side, local network problems).
- To request a refund, please send an email to support@youcast.cloud with: your full name or company name; your registered account email; date of payment; reason for requesting a refund; refunds, if approved, will be processed within 7 business days to the original payment method.
19. Payment Terms
- All fees for the use of Youcast.cloud are stated in U.S. Dollars (USD) unless explicitly stated otherwise. Pricing and available plans are published on the official website and may be updated periodically.
- Payment Schedule: All payments must be made in advance, prior to accessing any paid functionality of the platform. You are responsible for keeping your billing information up to date.
- Invoices & Receipts: An electronic receipt or invoice will be automatically generated and sent to the email address associated with your account upon successful payment.
- Payment Processing: Payments are processed via certified third-party providers in compliance with international security standards. The available payment methods are displayed during checkout.
- Renewals: Some plans may be offered on a recurring basis (subscription model). If enabled, you will be charged automatically according to your billing cycle unless the subscription is canceled before the renewal date.
- Failed Payments: If a payment is declined or cannot be processed, access to paid features may be suspended until payment is resolved.
